Description: Please join Ad Idem for a free CLE webinar program on how ethical issues arise for attorneys and parties through work with experts. The course will examine an attorney’s obligations and ability to preserve protections over confidential client information, including through the use of consulting experts as opposed to testifying experts. The course will also discuss how claims of an expert’s conflicts or agreements to keep opinions confidential have been addressed by courts, including the various ways in which attorneys have attempted to “sideline” experts and their opinions. The course also will discuss how attorneys’ ethical obligations impact how experts can be compensated, with additional distinctions between consulting and testifying experts. Finally, the course will address the limits of attorney and client involvement in preparing expert reports.
