Description: A class action against Delta Air Lines filed May 30, 2023 alleges that the airline inaccurately claimed it is the world’s “first carbon-neutral airline” and is liable for damages. Delta is just one recent subject of greenwashing scrutiny that is increasingly widespread as there has been a proliferation of environmentally-focused marketing and corporate communications in the marketplace. Consumers, shareholders and other stakeholders expect corporations to align with their values or work to mitigate ESG risks. The headlines highlight not just the financial and regulatory, but also the reputational risk companies face. Plus, the Federal Trade Commission (“FTC”) is in the process of updating its “Green Guides,” which the FTC offers as interpretive guidelines for environmental marketing, making this a particularly opportune time for companies to evaluate potential greenwashing risk. Substantiating and clarifying any environmental statements or policies will help safeguard against the inevitable greenwashing claims that will result from the forthcoming revised Green Guides.
