Description: In this first part of a 2-part series, our panel of experienced counsel, including a former U.S. Attorney, will discuss managing risk with a particular focus on DOJ prosecution of FCA claims related to DEI programs. We will discuss how the DOJ may use the FCA to investigate and pursue claims against any recipient of federal funds, and how to manage the risk of FCA prosecution with respect to DEI initiatives. We will also discuss in-house initiatives, comments/memos by justice officials, policies and executive orders, providing practical guidance for managing risk in the current environment.
