Description: In June 2023, the New York State Assembly passed a bill that would ban nearly all employer non-compete agreements and certain restrictive covenants. If signed into law, New York will join California, Illinois, Maryland, Colorado, DC, Minnesota, Oklahoma and North Dakota in a growing list of states that have either completely banned or limited non-compete agreements for employees. The New York law has attracted attention because it would ban non-competes for all employees, irrespective of compensation level, and because of liquidated damages that could expose companies to class action litigation.
