Description: This webinar will focus on the novel and aggressive use of consumer protection and public nuisance laws by state enforcement entities, with a focus on environmental, products liability, and digital platform spaces.
State AGs—along with other state enforcement agencies—use the power granted them through consumer protection and public nuisance statutes in unique ways to get around the normal regulatory processes, such as rule making or legislation. For instance, in the environmental context, AGs can bring a public nuisance claim against a company alleging their actions created a general “public nuisance” as opposed to pointing to a specific point of contamination. Similarly, in the products space, we’re seeing AGs bring public nuisance claims against companies for claims that are normally filed by private plaintiffs as products liability actions. Using litigation, as opposed to the normal regulatory channels, also allows states to react quickly to new areas or threats while bypassing traditional rulemaking avenues as seen in the litigation against social media companies and other digital platforms. This webinar will survey the landscape of state enforcement and briefly touch on strategies for handling pending or forthcoming litigation.
